These general terms and conditions apply to all services of f immobilien ag – in particular brokerage, sale and letting of real estate, valuations, client representation and construction supervision – as well as to the use of this website. Deviating agreements apply only if made in writing; they take precedence over these terms.
All information on properties – areas, volumes, years of construction, plans, visualisations, fittings, ancillary costs and prices – is based on documents and information from third parties and is passed on to the best of our knowledge. It is non-binding and without warranty. Only the information in the contractual documentation and in the notarised deed is authoritative.
Property offers are without obligation. Interim sale, interim letting and the withdrawal of a property by the ownership remain reserved at all times; there is no claim to conclusion.
Brokerage, valuation and client-representation mandates come about through a written contract, which governs in detail the scope of services, duration, exclusivity and the fee or commission. These terms apply additionally.
We provide our services carefully and in the client's interest. A specific result – in particular the conclusion of a purchase or tenancy agreement at a particular price or within a particular period – is not owed, unless expressly agreed otherwise.
Sales documentation, plans, photographs and other documents are provided to interested parties exclusively for their own use. Disclosure to third parties – even in part or in electronic form – requires our prior written consent. If unauthorised disclosure leads to a conclusion with a third party, the claim to commission against the disclosing person remains reserved.
Viewings take place by appointment. They presuppose full personal details and, for properties for sale, information on financing. Entering the property is at one's own responsibility; on construction sites, the instructions of the site management must be followed.
We are liable for damages arising from our services only in the event of intent or gross negligence. Liability for slight negligence, for auxiliary persons and for indirect damage and lost profit is excluded to the extent permitted by law. We accept no liability for information and documents from third parties or for the interruption or unavailability of this website.
The processing of personal data is governed by our privacy policy. We are obliged to comply with the legal requirements for combating money laundering and may, in that context, request identification documents and information on the origin of funds.
All documents, texts, photographs and designs created by us remain our property and are protected by copyright. Use beyond the agreed purpose is not permitted.
We may amend these terms at any time. For an existing mandate, the version in force at the time of conclusion of the contract applies.
Swiss law applies exclusively. The place of jurisdiction is – to the extent permitted by law – the registered office of f immobilien ag. Mandatory places of jurisdiction remain reserved.
